Benidorm Mobility Scooter Rules (2026): What the Crackdown Means for You

You can still hire a mobility scooter in Benidorm. The enforcement is aimed at people who ride one for fun without needing it, not at the visitor who does.

Below is what Benidorm's mobility ordinance actually says, article by article, and where the newspaper version of it is wrong.

Source: Ayuntamiento de Benidorm, Ordenanza Municipal n. 1, de Movilidad, published in the B.O.P. de Alicante n. 231 of 3 December 2020, article 4 revised in n. 80 of 30 April 2021. Articles 133 to 136. Last checked against that text on 6 September 2026.

The short answer

A mobility scooter in Benidorm is legally a pedestrian. Article 134.1 says so outright, which is why no driving licence is involved and why the rules for electric scooters do not apply to you.

You ride on the pedestrian area at walking pace. You carry your copy of the rental contract. You do not carry a passenger unless the machine was built for two. That is most of it.

What Benidorm has actually banned

Not much of what you have read, and one or two things you may not have expected.

Benidorm mobility ordinance, articles 134.1 to 134.9
ArticleWhat it says
134.1A mobility scooter counts as pedestrian traffic. It is not a personal mobility vehicle, which is what the electric scooter rules are written about.
134.2Ride on the pedestrian area, at walking pace. Only if there is no pedestrian area, or it is impassable, do you use the verge, and the carriageway after that.
134.3You may use the carriageway even where there is a footway, as long as you ride carefully and at walking pace, never let another vehicle tow you, obey officers and traffic lights, light up in the dark or in bad weather, and go with the traffic.
134.5A hired scooter may be ridden only by the person named on the rental contract.
134.6No passengers, unless the scooter is built to carry an extra occupant.
134.7Do not park where you block pedestrians or traffic, or in front of an entrance or exit.
134.8No riding under the influence of alcohol, drugs or psychoactive medication. Police may test you under the ordinary traffic rules, and the machine can be impounded.
134.9Carry your copy of the rental contract while you ride.

Who risks a fine, and how much

A mobility scooter offence in Benidorm is a minor offence. Article 136.1 classes them that way, and article 75.1 caps a minor offence at 100 euro.

The 500 euro figure that circulates is real, but it is the ceiling for very serious offences in the same ordinance. It is not the tariff for riding a mobility scooter.

Speeding is the exception, because that follows the national traffic authority's own scale rather than this ordinance.

Where the headlines and the ordinance disagree

Three things the coverage gets wrong

"A 500 euro fine for riding a mobility scooter." No. That is the maximum for very serious offences. Scooter offences are minor under article 136.1, capped at 100 euro under article 75.1.

"You need 60,000 euro of insurance." No. Article 135.d puts that obligation on the hire firm, per scooter. It is our cover, not something you buy.

"Mobility scooters are banned from the pavement" or "limited to 20 km/h in the cycle lane." Those are the rules for personal mobility vehicles, the electric stand up scooters, from a different part of the same ordinance. Article 134 puts mobility scooters on the footway at walking pace.

Can tourists still hire a mobility scooter in Benidorm?

Yes. The ordinance sets conditions on who may hire one, not on nationality or on being a visitor.

Article 135.b says the rental contract is drawn up in Spanish, Valencian and English, that it names both parties, and that the hirer has to establish their reduced mobility, whether that is a physical limitation or an illness, permanent or temporary, or else meet the minimum age. Article 135.c requires the firm to display a multilingual notice, in the shop and in the contract, that hiring to people without a mobility limitation or under the minimum age is forbidden.

A firm that hands you a scooter without asking any of this is not doing you a favour. It is the behaviour the enforcement exists to stop.

More on who can hire and what you will be asked

The minimum age is the one number we will not give you

The ordinance text of 2020 and 2021 says 55, and so did the council's own information page in July 2022. Reporting from March 2026, around the enforcement campaign, says 65. The ordinance may have been amended after 2022. We have not been able to confirm which figure is in force.

So we publish our own rule instead, which is safe under either reading: we hire to people aged 65 or over, or to people with a mobility limitation.

Once the council confirms which figure is in force, it goes here.

How to stay on the right side of the rules

  • Ride on the footway, at walking pace. That is article 134.2 and it is the rule people forget first.
  • Keep your copy of the contract with you. Article 134.9 makes it the rider's job, not the hire firm's.
  • Do not lend it to anyone, not even for five minutes. Only the person on the contract may ride it, under article 134.5.
  • Two people means a machine built for two. Article 134.6 allows no other version of that.
  • Lights on at dusk and in poor weather, under article 134.3.
  • Nothing to drink before you ride. Article 134.8 puts a scooter under the same drink driving regime as any other vehicle here.
  • Park clear of doorways and of the flow of people, under article 134.7.
  • Hire from a firm that asks you the awkward questions. Articles 135.a to 135.d are obligations on us, and a firm that skips them is telling you something.

Hire one that is properly arranged

We hire to people aged 65 or over or with a mobility limitation, we put your name on the contract, and we hand you your copy of it.

Frequently asked questions

Do I need a disability to hire a mobility scooter in Benidorm?
You need either a mobility limitation or to meet the minimum age. Article 135.b of the ordinance requires the hirer to establish reduced mobility, permanent or temporary, or else be old enough. Our own rule is 65 or over, or a mobility limitation.
Can two people ride one mobility scooter?
Only on a machine built for two. Article 134.6 forbids carrying a passenger except on a scooter constructed to take an extra occupant, which is what a double mobility scooter is.
Can I have a drink and then ride back?
No. Article 134.8 forbids riding under the influence of alcohol, drugs or psychoactive medication, and the police may test you as they would any driver. The machine can be impounded.
Where can I park it?
Anywhere you are not blocking people or traffic, and not across a doorway. That is the whole of article 134.7.
Do I need a driving licence?
No. Article 134.1 makes riding a mobility scooter pedestrian traffic, so the licensing rules for drivers do not reach it.
Is there a speed limit?
Walking pace on the pedestrian area, under article 134.2, and walking pace again if you use the carriageway under article 134.3. Speeding is the one offence that follows the national scale rather than the local one.
